Welcome to UseFreelancer.com.com.

The following terms of service (these "Terms of Service"), govern your access to and use of the UseFreelancer.com website and mobile application, including any content, functionality, and services offered on or through www.UseFreelancer.com or the UseFreelancer.com mobile application (the "Site") by UseFreelancer.com  (15070 66A Ave., Surrey BC Canada). UseFreelancer.com is referred to here as "UseFreelancer.com" "we" or "us" and "you" or "user" means you as a the user of the Site.

Please read the Terms and Conditions carefully before you begin using the Site. By using the Site, opening an account or by clicking to accept or agree to the Terms of Service when this an option is made available to you, you accept and agree, on behalf of yourself or on behalf of your employer or any other entity (if applicable), to be bound and abide by these Terms of Service, UseFreelancer.com Payment Terms, found here (“Payment Terms”), and our Privacy Policy, found here, each of which is incorporated herein by reference. If you do not wish to agree to these Terms of Service or the Privacy Policy, you must not access or use the Site. For more detailed policies regarding the activity and use of the Site, please refer to the articles herein.

This site is available for users aged 14 and over. If you are under 14, you cannot use UseFreelancer.com. By using this Site, you represent and warrant that you are of legal age to enter into a binding contract and satisfy all of the aforementioned eligibility requirements. If you do not meet all these conditions, you must neither access nor use the Site.


Our customer support team is available 24 hours a day, 7 days a week, should you have any questions regarding the site or the terms of use. You can reach out to our client support team by submitting a support ticket.

The original language of these Terms of Use, along with all other texts of the website is English. UseFreelancer.com makes this translation available as a convenience only. In the event of a conflict between the original English version and any translation, the English version shall take precedence.

Key Terms

Buyers are users who purchase services on UseFreelancer.com.

Custom orders are requests made by a buyer for a personalized offer from a seller.

The extra gig is additional services provided in addition to the seller's Gig for an additional price set by the seller.

Gig packages allow sellers to provide services in a variety of formats and prices. Packages may include upgrades, allowing sellers to price their service for a base price in excess of $5. to  $10,000 ( Five to ten thousand USD)

The Gig page is where the seller can describe his Gig and the conditions of the Gig, and the buyer can buy the Gig and make an order.

Gig/ Gigs are services offered on UseFreelancer.com

The order page is where Buyers and Sellers communicate with one another in relation to a Gig ordered.

Orders are the official arrangements between a buyer and the seller after a purchase has been made from the seller's Gig page.

Sellers are users who offer and perform services through Gigs on UseFreelancer.com.

Overview (Primary terms, in a nutshell)


  1. Only registered users can buy or sell on UseFreelance.com. It is free to register. By signing up for an account, you agree to provide us with accurate, complete, and up-to-date information and should not create an account for fraudulent or deceptive purposes. You are solely responsible for any activity in your account and for keeping your password confidential and secure. We are not responsible for anything you do or do not do in connection with your account.
  2. Gigs on UseFreelancer.com may be offered at a base starting price of $5. Some Gigs are offered at a basic price greater than $5 as determined by the seller.
  3. Buyers pay UseFreelancer.com in advance to create an order (see Payment Terms ).
  4. Orders are purchased using the Order button on the seller's Gig page or using a customized offer.
  5. For fees and payments, please read the Payment Terms
  6. Sellers must fill their orders and may not cancel orders regularly or without reason. Canceling orders will affect the reputation and status of the sellers.
  7. Sellers gain account statuses (Levels) based on their performance and reputation. Advanced salespeople get advantages, including paying UseFreelancer.com a lower commission and keeping more profit from their Gigs. Users are prohibited from offering or accepting payments other than through the placing of an order on UseFreelancer.com.com.
  8. When purchasing a Gig, Buyers receive all rights for the work delivered unless otherwise stated by the Seller on their Gig page.
  9. UseFreelancer.com reserves the right to use any published work delivered and logo designs for marketing and promotional purposes on UseFreelancer.com.
  10. We care about your privacy. You may read our Privacy Statement here. The Privacy Policy forms part of these Terms of Use and is included herein by reference.
  11. Users undertake to comply with UseFreelancer.com’s Standards, which are a set of behavior rules and guidelines, applicable to the UseFreelancer.com and marketplace in addition to these Terms of Service, as updated from time to time.

Sellers


Basics

  1. Sellers create Gigs on UseFreelancer.com to allow Buyers to purchase their services.
  2. Sellers may also offer Custom Offers to Buyers in addition to their Gigs.
  3. UseFreelancer.com Sellers are divided into levels Seller levels (see Levels below) and each Gig that the seller successfully complete, we will accredit his account as follows :

  1. UseFreelancer.com accredits Sellers once an order is completed. See our "Orders" section below for a definition of a completed order.
  2. For more information about receiving payments, fees and taxes see the  Payment Terms .
  3. Sellers can promote their Gigs or any UseFreelancer.com content via the Google Ads platform.
  4. The Seller rating is calculated based on the order reviews posted by Buyers. High ratings allow sellers to earn more money and obtain advanced Seller levels (see Levels below). In some cases, extremely weak ratings can lead to suspension of the seller's account.
  5. For security reasons, UseFreelancer.com can temporarily disable the ability of a seller to withdraw revenue to prevent fraudulent or illicit activities. This may be the result of security issues, improper behavior reported by other users or linking multiple UseFreelancer.com accounts to a single withdrawal provider.
  6. Sellers are responsible for obtaining a general liability insurance policy, the amounts of which are sufficient to cover all risks related to the provision of their services.

Gigs


  1. UseFreelancer.com limits its seller to post a limited number of Gigs according to each seller level but UseFreelancer.com allows sellers to post as many Gigs as they like.
  2. Gigs created on UseFreelancer.com are User Generated Content.
  3. Gigs and/or users may be removed from UseFreelancer.com for violations of these Terms of Use and/or our Standards, which may include, without limitation, the following violations:
  • Illegal or Fraudulent services
  • Copyright infringement, trademark infringement, and violation of third party terms of service
  • Adult services, pornography, inappropriate/obscene.
  • Purposely copying Gigs.
  • Spam, nonsense, or violent or misleading performances.
  • Gigs misleading to Buyers or others
  • Shows of really bad quality Gigs.
  • Promoting UseFreelancer.com and/or UseFreelancer.com Gigs through activities that are prohibited by any laws, regulations, and/or third parties' terms of service, as well as through any marketing activity that negatively affects our relationships with our users or partners.
  1. Gigs that are deleted for violations mentioned above, may lead to the suspension of the Seller's account.
  2. Gigs that are deleted because of violations are not eligible to be restored or changed.
  3. Gigs can be removed from our search function due to bad performance and/or user misconduct.
  4. Gigs can include pre-approved website URLs contained in Gig's description and requirements box. Gigs containing websites promoting content, which violates UseFreelancer.com's Terms of Service and/or our standards, will be deleted.
  5. The gigs must have a suitable gig image related to the service offered. An option to upload more additional Gig images is available to all sellers. Salespeople should provide the same quality of service as their Gig images. Recurring deliveries that do not match the quality shown on the Gig images may result in the loss of the seller's account seller status or permanent deactivation.
  6. Gigs can hold an approved Gig video uploaded via the Gig management tools available on UseFreelancer.com.
  7. Statements on the Gig page that undermine or bypass these Terms of Use are not permitted.
  8. Eligible Gigs in certain categories may have Gig plans in place to offer their services in structured formats with multiple price points for the selected Gig.

Levels


UseFreelancer.com is about helping sellers put their skills to work. We aim to empower the most efficient sellers to develop their business. Sellers who invest in self-promotion have the potential to increase customer satisfaction. And, if they deliver on time and maintain high quality and ratings, UseFreelancer.com will reward them with more earrings and benefits, and tools that come with it.

  1. UseFreelancer.com Sellers can earn more based on their activity, performance, and reputation. Requirements for advancement can be found here.
  2. Advancement in levels is updated periodically by an automated system.
  3. The current levels that a seller may reach are New Seller Level, 1, 2, and Top Rated.
  4. Sellers who cannot maintain their high-quality service, experience a severe drop in ratings, or stop delivering on time risk losing their seller status and the earnings that come with it? For example, late deliveries, warnings to the Seller’s account, and cancellations can cause a seller to move to a different Level.
  5. Advanced levels provide their owners with additional earnings, according to their level as follows

For example: You must complete 5 Gigs with a minimum customer rating of %80 to become a Level 1 Seller. You must complete 10 Gigs with a score of 90% or higher to become a Level 2 seller. And you must complete 15 Gigs with a minimum rating of %100 to become a Top-Rated Seller.

UseFreelancer.com Sellers have access to several exclusive features that help customize the way their services can be offered as follows”

  • Message system with emojis added to video chat for instant messaging and file transfer during the video chat session
  • Type status indicating to buyer and seller when someone is typing

  • Calendar and time feature to allow the buyer to set a date and time when both of them are available to do the video chat
  • Recording feature implemented for the buyer to have an option to record video chat and download in .mp4 version

  • Inbox Messages with both the buyers and sellers are constantly in the loop, and efficiency improves communication.
  • Orders Delivered. When a seller delivers an order, the buyer gets an instant text message to their mobile.
  • Support Answered; UseFreelancer.com support systems are fully integrated, users get text messages whenever an admin responds to his or her support ticket.
  • Proposal Approval or Decline: Once the admin approves or declines a proposal, the user will get a text message regarding that.
  • Modifications Requested: Seller gets a text message whenever a buyer sends a modification request after an order is delivered.
  • Withdrawal Request: Whenever a withdrawal request is approved or declined, the seller will get an instant text message.
  • Reviews Submitted: Whenever a buyer gives a review, the seller will get a text message for that action.
Seller Affiliates
  1. For each Gig the seller posts he can activate the Affiliate link for such Gig and specify the % he likes to pay to his affiliate, Example %5.
  2. Any the person browsing UseFreelancer.com and see the Seller Gig can easily Click the Affiliate icon and copy the affiliate link (URL) and use it in any location of website on the internet to promote the seller GIg,
  3. Affiliate must be a member of UseFreelancer.com (can be a buyer or a seller)
  4. As soon as the Gig is completed the Affiliate will automatically get paid and the balance will go to the seller.
  5. When an affiliate sells a Gig to a seller the seller will be notified before he accepts the buyer.
Seller Coupons
  1. The seller can create his own coupons so that his customers can apply his coupon code and save money when they buy his Gigs.
  2. As soon as a buyer applies a coupon code to a Gig he will get the total price after discount which will be displayed to the seller.
Custom Offer
  • Sellers can also submit personalized offers that meet a buyer's specific requirements.
  • The personalized offers are defined by the seller with the exact description of the service, the price and the time provided for the delivery of the service.
  • Customized offers are sent from the talk page.
  • Services provided through the Personalized Offers may not breach the UseFreelancer.com Terms of Service and/or our Standards.
  • Project Milestones:
Shipping Physical Deliverables
  1. Some of the services on UseFreelancer.com are delivered physically (arts and crafts, collectors' items, etc.). For these types of Gigs, Sellers may decide to add shipping charges. Sellers may include shipping charges for local shipping (in the same country) and international shipping (anywhere else).
  2. Gigs which include shipping fees must be accompanied by physical deliverables sent to purchasers.
  3. Shipping fees added to a concert are only about the cost sellers need to ship physical items to the buyer
  4. Important: Buyers who buy Gigs requiring physical delivery must provide a delivery address.
  5. sellers are responsible for all shipping arrangements when the purchaser provides the shipping address.
  6. UseFreelancer.com does not handle or guarantee shipping, tracking, quality, and condition of items or their delivery and shall not be responsible or liable for any damages or other problems resulting from shipping.
  7. A tracking number is an excellent way to avoid shipment disputes. We have to enter the tracking number if it is available on the order page when you deliver your work.

Buyers


Basics

  1. You cannot offer direct payments to sellers using payment systems outside UseFreelancer.com.
  2. UseFreelancer.com reserves the right to use all publicly available works for marketing and promotional purposes on UseFreelancer.com.
  3. Buyers may request a specific service from the Post a Request feature. Services ordered on UseFreelancer.com should be an authorized service on UseFreelancer.com.  Users must refrain from using Post a Request for any purpose other than searching for services on UseFreelancer.com.
Purchasing
  1. Please refer to the  Payment Terms for making Payments through the UseFreelancer.com platform and to learn about fees and taxes.
  2. In addition, Buyers can request a Custom Order which addresses specific Buyer requirements, and receive a Custom Offer from Sellers through UseFreelancer.com.
  3. You may not offer Sellers to pay or make the payment otherwise than through UseFreelancer.com. If you are asked to use a different payment method, please report it immediately to UseFreelancer.com.

Orders


Basics

  1. Once payment is confirmed, your order will be created and given a unique UseFreelancer.com order number.
  2. Sellers must deliver completed files and/or proof of work according to the service that was purchased and advertised on their Gig.
  3. The Delivery of Work may not be abused by the Sellers to circumvent Order guidelines described in these Terms of Service. Using the Delivery of Work, when an Order was not fulfilled, may result in a cancellation of that order after review, affect the Seller’s rating, and result in a warning to Seller.
  4. An Order is marked as Complete after it is marked as Delivered and then accepted by a Buyer. An Order will be automatically marked as Complete if not accepted and no request for the modification was submitted within 3 days after the order was marked as Delivered.
  5. We encourage our buyers and sellers to try to resolve their differences. If for any reason this fails after using the Resolution Center or if you encounter unauthorized use of the Site, users may contact UseFreelancer.com Customer Support for assistance. For more information about disputes, Order cancellations, and refunds please refer to the  Payment Terms .
  6. A milestone (on an Order with milestones) is marked as Complete after it is delivered by the Seller and then accepted by the Buyer.
  7. UseFreelancer.com’s Order Cancelation policy under the  Payment Terms will apply.
Handling Orders


  1. When a buyer orders a Gig, the seller is notified by e-mail together with notifications by UseFreelancer.com mobile multilayer and on the site while being logged into the account.
  2. Sellers are required to meet the delivery time they specified when creating their Gigs. Failing to do so will allow the Buyer to cancel the Order when an Order is marked as late and may harm the Seller's status.
  3. Sellers must submit the completed files and/or proof of work via the Deliver Completed Work button (located on the Order page) to indicate that the order has been delivered.
  4. Users are responsible for scanning all files transferred for viruses and malicious software. UseFreelancer.com will not be held responsible for any damages that may occur due to the use of the site, the use of the content, or files transferred.
  5. Buyers may use the "Request Revisions" feature located on the Order Page while an Order is marked as Delivered if the delivered materials do not match the Seller's description of their Gig page or they do not match the requirements sent to the Seller at the beginning of the order process.
Reviews


  1. Feedback provided by purchasers while completing an order are an essential part of the UseFreelancer.com notation system. Reviews demonstrate the overall experience of the buyer with the vendors and their service. Buyers are encouraged to share their concerns with the seller during their active order regarding the service provided by the seller.
  2. Leaving a Buyer's feedback is a basic prerogative of a Buyer. Feedback reviews will not be deleted unless there are clear violations of our conditions of service and/or standards.
  3. To prevent misuse of our feedback system, all comments must originate from legitimate sales executed exclusively on the UseFreelancer.com platform. Arranged purchases, determined to artificially improve vendor appraisals, or to abuse the UseFreelancer.com platform with additional account purchases will result in a permanent suspension of all related accounts.
  4. Buyer reviews are publicly posted on the vendor's Gig page.
  5. Examples of work are images and videos sent to a buyer in a delivered post. The work samples are added to a seller's live portfolio on their Gig page if the buyer chooses to publish the work sample while providing a public feedback review.
  6. It is prohibited to withholding the delivery of services, files, or information required to complete the Gig’s service with the intent to gain favorable reviews or additional services.
  7. Once the Work is delivered the Buyer has three days to post a review. If no response is provided within the response period, the Order will be considered completed.
  8. Users are allowed to leave reviews on orders up to 10 days after an order is marked as complete. No further notification can be added to an order after 10 days.
  9. Sellers cannot seek withdrawal of comments from their buyers through mutual cancellations.
Disputes and Cancellations

We encourage our buyers and sellers to try to resolve disputes with each other. If for any reason this fails, you can open a Dispute Support and it will go to the Resolution Center. If you encounter unauthorized use of the Site, users may contact UseFreelancer.com Customer Support. User Conduct and Protection

UseFreelancer.com allows people from all over the world to create, share, sell and buy almost anything they need at unbeatable value. The services offered on UseFreelancer.com reflects the diverse nature of a growing economy. Members of the UseFreelancer.com communicate and engage through orders, social media, and the UseFreelancer.com blog.

UseFreelancer.com keeps the environment friendly, communal, and professional. Users must maintain this spirit while participating in any UseFreelancer.com activity or expansion. This section focuses on the expected conduct that users must adhere to when interacting with each other on UseFreelancer.com.

To report a breach of our Terms of Service and/or Standards, user misconduct, or account requests, please contact our Customer support center. team

Basics


  1. To protect the privacy of our users, their identities are anonymous. Requesting or providing Email addresses, Skype usernames, telephone numbers, or any other personal contact details to communicate outside of UseFreelancer.com in order to circumvent or abuse the UseFreelancer.com messaging system or UseFreelancer.com platform is not permitted.
  2. Any exchange of personal information needed for the continuation of a service may be exchanged within the order page.
  3. UseFreelancer.com does not provide any guarantee of the level of service offered to Buyers. You may use open a dispute, at our tech support.
  4. UseFreelancer.com does not protect users that interact outside of UseFreelancer.com.
  5. All information and file exchanges must be conducted exclusively on UseFreelancer.com.
  6. Rude, abusive, inappropriate, or violent messages will not be tolerated and could result in an account warning or suspension or removal from your account.
  7. UseFreelancé.com is open to all. Discrimination against a member based on gender, race, age, religious affiliation, sexual preference or other grounds is not acceptable and may result in suspension or removal of your account.
  8. Users may not submit proposals or solicit parties introduced by UseFreelancer.com to enter into, engage or pays outside UseFreelancer.com.
Orders


  1. Users with the intention to defame competing Sellers by ordering from competing services will have their reviews removed or further account status related actions determined by review by our Trust & Safety team.
  2. Users should refrain from spamming or soliciting previous buyers or sellers to remove/modify notifications or cancel orders that do not comply with order cancellation or feedback policies.
Gigs


  1. Users may report Gigs to Customer Support that may be in breach of the UseFreelancer.com Terms of Service depending on the replicated the similarity of Gig reported with pre-existing services (copies of Gigs).
  2. Sellers warrant that any content included in their Gigs shall be the original work conceived by the Sellers and shall not infringe any third party rights, including, without limitation, copyrights, trademarks or service marks. In the event that certain music or stock-footage media are incorporated within the Gigs, Sellers represent and warrant that they hold a valid license to use such music and/or footage and to include them in the Gigs.
  3. UseFreelancer.com will respond to clear and comprehensive notices of alleged copyright or trade-mark infringement.
Reporting Violations

If you find content that could violate our Terms of Service and/or Standards. You should bring this to our attention through the appropriate channels established to address these issues, as outlined in our Terms of Service. All cases are reviewed through our Trust and Security team. In order to protect personal information, the results of the investigation are not communicated. You can consult our Privacy Policy to find out more.

Violations


Users may receive a notice on their own behalf for violations of our Terms of Use and/or our Standards or any user misconduct. A warning will be sent to the user's email address and will be displayed to that user at the Site. Warnings do not limit account activity but may result in loss of seller status or permanent deactivation of your account based on the severity of the breach.

Non-Permitted Usage


  1. Adult Services & Pornography - UseFreelancer.com does not permit any interchange of pornographic or adult-oriented material and services.
  2. Inappropriate Behavior & Language - UseFreelancer.com communication needs to be user-friendly, constructive, and professional. UseFreelancer.com condemns bullying, harassment, and hateful remarks against others. We provide users with a means by which messages are exchanged among individuals. A system for assessing orders and engaging with larger platforms such as our forum and social media pages.
  3. Phishing and Spam - Members’ security is our top priority. Any attempt to publish or send malicious content with the intent to compromise another member's account or computer environment is strictly prohibited. Please respect the confidentiality of our members by not contacting them with offers, questions, suggestions, or anything that is not directly linked to their concerts or orders.
  4. Privacy & Identity - You cannot publish or display the private and confidential information of other persons. Any sharing of personal information required to perform a service must be done through the order page. Sellers also confirm that whatever information they receive from the Buyer, which is not public domain, shall not be used for any purpose whatsoever other than for the delivery of the work to the Buyer. Users who engage and communicate from UseFreelancer.com will not be protected by our Terms of Service.
  5. Authentic UseFreelancer.com Profile - You may not create a false identity on UseFreelancer.com. Make a false representation of your identity or create a UseFreelancer.com profile for anyone other than you (an actual person), or use or try to use another user's account or information. Your profile information, including your description, skills, location, etc., may remain anonymous, must be accurate and complete, and may not be misleading, illegal, offensive, or otherwise injurious. UseFreelancer.com reserves the right to require users to undergo a verification process to use the Site (whether by using ID, phone, camera, etc.).
  6. Intellectual Property Claims - UseFreelancer.com will respond to clear and comprehensive notices of alleged copyright or trademark infringement and/or breach of third-party terms of service.
  7. Fraud / Unlawful Use - You are not permitted to use UseFreelancer.com for illegal purposes or to engage in illegal activities.
  8. Abuse and Spam
  9. Multiple Accounts - To prevent fraud and misuse, users are limited to a single UseFreelancer.com account. Any additional account determined to be set up to circumvent the guidelines, promote competitive advantages, or mislead UseFreelancer.com will be deactivated. Creating mass accounts can deactivate all associated accounts. Note: Any violation of UseFreelancer.com's Terms of Service is a cause for permanent suspension of all accounts.
  10. Targeted Abuse - We do not tolerate users who abuse or harass others through UseFreelancer.com. This includes the creation of new multiple accounts to harass members through our message or command system.
  11. Selling Accounts - You are prohibited from purchasing or selling UseFreelancer.com accounts.
Proprietary Restrictions

The site, including its general layout, design, and content, is the exclusive property of UseFreelancer.com and is subject to copyright and trade-marks. UseFreelancer.com®, is a registered trademark owned exclusively by UseFreelancer.com. Users have no right and agree not to, do the following with respect to the Site or any part, component, or extension of the Site (including its mobile applications) as follows. (1) Copy, transfer, adapt, alter, distribute or reproduce in any way. (2) Assemble, decompile, reverse engineer or otherwise try to derive its source code, underlying ideas, algorithms, structure, or organization. (3) Alter or create derived works. (4) Remove any copyright notices, identification, or any other proprietary notices, or. (5) Use the Site in a manner that may damage, disable, overload, or obstruct the Site, or adversely affect the enjoyment of the Site by any other user. Users also agree not to allow or allow another person to do any of these things.

Feedback Rights

As long as you provide UseFreelancer.com with any comments, suggestions, or other comments about UseFreelancer.com. Or the whole of the Site, as well as other UseFreelancer.com products or services (collective, the «Feedback»). You will be deemed to have granted UseFreelancer.com an exclusive, royalty-free, fully paid, perpetual, irrevocable, worldwide ownership right in the Feedback. UseFreelancer.com is not responsible for implementing comments it may receive from users.

Confidentiality

Sellers acknowledge that certain confidential information may require disclosure by buyers. To be used by salespeople to deliver the work ordered. And to protect this confidential information against unauthorized use and disclosure. As a result, vendors agree to treat any information received from buyers as highly sensitive, top-secret and classified material. Without departing from the generality of the foregoing, sellers expressly commit themselves to. (1) Maintain all such information in strict confidence. (2) Withhold information from third parties. The following terms (these “Payment Terms”) govern payments you make or receive through www.UseFreelancer.com.com (the “Site”), operated by UseFreelancer.com (15060 66A Ave., Surrey, B.C. Canada).

Please read these payment terms thoroughly before making or receiving payments on UseFreelancer.com. By making or receiving payments via UseFreelancer.com, you consent to and accept. on your own behalf or on behalf of your employer or any other entity (if applicable), to be bound by and abide by these Terms of Payment. These Conditions are in addition to the UseFreelancer.com General. Terms of Service as applicable (collectively, the “Terms of Service”).

Key Terms

Capitalized terms used but not defined herein have the respective meanings as set forth in the Terms of Service.

UseFreelancer.com Balance is the accumulated amount of your sales earnings and/or returned payments from canceled orders as a buyer.

Payment Services Provider(s) Are service providers that provide payment services to buyers and sellers related to UseFreelancer.com. Including fundraising from buyers regarding purchases, remittances, and withdrawal of funds from sellers. Currency exchange services related to payments and withdrawals in a local currency, and holding of funds related to UseFreelancer.com balances.

Revenue is the money that sellers earn from finished orders and can either withdraw or use to buy on UseFreelancer.com, subject to these Terms.


Receiving Payments

  1. UseFreelancer.com accredits Sellers once an order is completed. Please refer to the "Orders" section of the Terms of Use for the definition of a completed order.
  2. If an order is canceled (regardless of the reason), the funds paid will be returned to the buyer's UseFreelancer.com balance.
  3. Sellers are responsible for payment of both direct and indirect taxes. Including GST, VAT, or income tax, which may apply to them depending on the residence, residence, or otherwise, under the provisions of their jurisdiction. Sellers declare and guarantee that they comply, and will comply at all times, with their obligations under their jurisdiction's tax provisions. The price is shown on the Gig page or includes all taxes and charges that may apply to the sellers.
  4. Appointment of Limited Payment Collector:. Seller hereby designates UseFreelancer.com as the payment recovery agent authorized by Seller only for the purpose of accepting payments (through its Payment Service Provider, if applicable) from the Buyer. And deliver those payments to the salesman.  Seller agrees that payment from the Buyer to UseFreelancer.com shall be considered as payment made directly to the Seller. Buyer's payment obligation to Seller will be satisfied upon receipt of payment by UseFreelancer.com (or its payment service provider, as applicable). And UseFreelancer.com (via its payment service provider, as applicable) is responsible for remitting the funds to the seller in the manner described in these payment terms. In the event that UseFreelancer.com (via Payment Services Provider) does not return such amounts to the Seller, the Seller shall only appeal against UseFreelancer.com and not the Buyer directly. The seller acknowledges that UseFreelancer.com may describe or otherwise reflect the terms contained in these Terms of Service. Receipts, disclosures, or notices, including, but not limited to, receipts provided to the Byers that UseFreelancer.com may find necessary or prudent.
  5. UseFreelancer.com partners with Payment Service Providers to collect payments from Purchasers, transfer such payments from Purchasers to Sellers and hold funds in relation to UseFreelancer.com Balances. All payment services associated with the withdrawal of funds to the UseFreelancer.com platform is executed by the payment service providers of UseFreelancer.com.

Withdrawing Revenues

  1. To withdraw your revenue, you need to have an account with one or more UseFreelancer.com payment service providers for the withdrawal methods listed below. All funds eligible to withdraw will be held in your name, in an account with the payment service provider of UseFreelancer.com.  All payment services, including pickup services, shall be provided by the payment service provider of UseFreelancer.com.
  2. Your UseFreelancer.com profile can be combined with a single account of each UseFreelancer.com withdrawal method. A Payment Service Provider withdrawal account can be associated with only one UseFreelancer.com account.
  3. Revenues can only be withdrawn from the revenue page after a 14-day security clearance period after the order has been marked as complete.
  4. Sellers can withdraw their earnings using one of the UseFreelancer.com withdrawal options (see the Withdrawal section below for payment terms). To withdraw your available revenue. Click the designated withdrawal provider to launch the withdrawal process.
  5. For security reasons, UseFreelancer.com can temporarily disable a provider's ability to withdraw income to prevent fraudulent or illegal activities. This may be the result of security issues, inappropriate behavior reported by other users or linking several UseFreelancer.com accounts.
  6. Withdrawals can only be made up to the amount available to you.
  7. The withdrawal fee will vary based on the withdrawal method.
  8. Withdrawals are final and are not subject to cancellation. We can't reverse this process after it starts.
  9. In In some cases, salespeople can receive income in several different currencies. All currency exchange services associated with such withdrawals are performed by the payment service providers of UseFreelancer.com. Your UseFreelancer.com balance is always derived from its value in American dollars and thus. The amount in the local currency of your UseFreelancer.com balance can change daily according to currency fluctuations and also includes conversion fees. Sellers always have the option to withdraw revenue in US$.
  10. Sellers will be able to withdraw their revenues from disabled accounts after a safety period of 90 days. Upon complete verification of ownership of the account in question, from the date of the last cleared payment received in their account and subject to the approval of UseFreelancer.com.

  1. Buyers pay UseFreelancer.com to create an order from a vendor service page (Gig) or a customized offer, using the Post a Request link. UseFreelancer.com partners with Payment Service Providers to collect all payments from Buyers, transfer such payments from Buyers to Sellers, and hold funds in connection with UseFreelancer.com Balances. All payment services associated with collecting funds on the UseFreelancer.com platform is performed by the payment service providers of UseFreelancer.com.
  2.  UseFreelancer.com is only used as the seller's limited authorized collector. In order to accept payments (through its Payment Service Provider, if applicable) from the Buyer, and to remit such payments to the Seller. Buyer's payment obligation to Seller will be satisfied upon receipt of payment by UseFreelancer.com (or its payment service provider, as applicable). And UseFreelancer.com (through its Payment Service Provider, if applicable) is responsible for delivering the funds to Seller as described in these Payment Terms. In the event that UseFreelancer.com (via Payment Services Provider) does not return such amounts to the Seller, the Seller shall only appeal against UseFreelancer.com and not the Buyer directly.
  3. In most locations, purchases on UseFreelancer.com may be made using any of the following payment methods: Credit Card, PayPal, UseFreelancer.com Credits, or UseFreelancer.com Balance. Additional payment methods may apply to some areas. More information regarding the available payment methods is available. here.
  4. Service charges are added at the time of purchase, where you may review and agree to the total amount requested to be paid. This fee covers administrative expenses.
  5. You may not offer Sellers to pay or make the payment otherwise than through UseFreelancer.com.com. In case you were prompted to use another method of payment, please report it immediately to customer support here.
  6. You agree to receive invoices and/or payment receipts from UseFreelancer.com in electronic form in the form of PDF documents, by e-mail or through the Website.
  7. To protect against fraud, unauthorized transactions (such as money laundering), complaints, or other responsibilities, Payment information related to withdrawals is collected by UseFreelancer.com or UseFreelancer.com payment service providers. Payment service providers may also gather other information needed to process withdrawal payments.  UseFreelancer.com is not exposed to the payment information provided to Payment Service Providers, and this information is subject to the privacy policy applicable to the Payment Service Provider. Please refer to our Privacy Statement for more information here.
  8. By using any payment method and/or providing payment details to make purchases on UseFreelancer.com, you declare and warrant that: (1) you have the legal right to provide this information. (2) you have the legal authority or permission to make payments by means of the payment method(s). (3) if you are an employee or agent of a company or person who owns the payment method. you are authorized by this company or person to use the means of payment to make payments on UseFreelancer.com. and (4) such measures are not in contravention of any applicable law.

Local Currencies

  1. You may pay on UseFreelancer.com in a variety of currencies. Unless otherwise indicated, you will be charged in the currency displayed on the checkout page. All foreign exchange services associated with local currency payments are performed by the payment service providers of UseFreelancer.com. In some cases, however, when certain currencies are not supported by certain payment methods, you will be charged in US dollars even though the price is shown in another currency. In all cases, the actual amount invoiced (in the actual payment currency) will be clearly disclosed to you before you finalize the payment.
  2. Note that all prices on UseFreelancer.com are still derived from their original price in American dollars and. As a result, prices of currencies other than US dollars may change daily due to fluctuations in exchange rates and may also include conversion fees. Buyers always have the option of paying in USD by changing the currency they have chosen.
  3. If you paid for an Order in a currency other than US$ and your Order was canceled later for whatever reason. The amount returned to your UseFreelancer.com account would be based on the exchange rate on the cancellation date. Therefore, the amount returned may vary relative to the amount paid in a local currency, while still retaining the same value in US dollars.
  4. Your UseFreelancer.com balance is still valued in US$ even though it is displayed in a currency other than the US. Therefore, should you choose to view your UseFreelancer.com balance is in a currency other than US$. it may change daily in response to fluctuations in the exchange rate while retaining the same value in US dollars. Users always have the option to view their UseFreelancer.com balance in US$ by changing their selected currency.

UseFreelancer.com Credits

In some cases, UseFreelancer.com can give you credits. Either for promotional or other purposes, to be used to buy Gigs and/or other services offered on the Website. Your available credit balance will be posted to your account. Your valid UseFreelancer.com credits will be automatically applied to your next purchase and will be visible in your order summary after you place your order. Unless otherwise specified, UseFreelancer.com credits expire 3 months after they are received. UseFreelancer.com credits are only used to encourage the use of UseFreelancer.com and, therefore, are not redeemable for cash, have no cash surrender value, and are not refundable. Once used, UseFreelancer.com Credits may not be sent back to your account even if your order is canceled. UseFreelancer.com Credits may be subject to additional conditions and restrictions that will be disclosed to you upon receipt of the Credits. Credits may be waived in case of fraud, abuse, or violation of these Terms. UseFreelancer.com reserves the right to modify or cancel the UseFreelancer.com credit scheme. If you or UseFreelancer.com deactivate or suspend your UseFreelancer.com account, all unused UseFreelancer.com credits in your account will be forfeited.
Promo Codes

From time to time, we may offer you promotional codes for the purchase of Gigs and/or other services offered on the Site, on special discounts. Promotional codes are only valid for purchases on UseFreelancer.com and have different time limits and will expire after their predefined term. To practice your promotional code, simply enter the code on the order page. If you do not, your purchase will not qualify for a rebate. Promotional codes are only for one use per user and cannot be used or combined with any other promotion. For orders composed of one or more milestones, the promotional code will apply to the first milestone only. Promotion codes are not applicable to UseFreelancer.com credits. Promotional codes may be subject to additional conditions and limitations that will be communicated to you upon receipt of promotional codes. Promotional codes may be waived in the event of fraud, misuse, or breach of the Terms of Use. UseFreelancer.com reserves the right to change or cancel the promotion codes at any time.

Taxes

  1. Under applicable legislation, UseFreelancer.com may be required to charge users indirect taxes (such as sales tax, VAT, or GST) or withhold taxes. Any amount UseFreelancer.com will be necessary to raise will be in addition to the purchase amount. and all other fees payable by the buyer, and any amount UseFreelancer.com must withhold, shall be deducted from the seller's income, as required by applicable law.
  2. Indirect taxes are added to the price displayed on the site, and in any event, these taxes will always be displayed to the Purchaser before payment.
  3. Users are responsible for the payment of direct or indirect taxes, including GST, VAT, or income tax, which may apply to them based on residency. Place or other, according to the provisions of their court.

Disputes and Cancellations

We encourage our purchasers and sellers to try to resolve disputes between them. If for any reason this fails after using the Resolution Center or if you encounter unauthorized use of the Site, users may contact UseFreelancer.com Customer Support. here.

Basics

  1. Order cancellations can be performed on UseFreelancer.com, if eligible, by customer support, or through the Resolution Center per order.
  2. The filing of litigation or cancellation of payment through your payment provider or bank constitutes a breach of these Payment Terms. You may have your account temporarily or permanently disabled. Note: Once you have filed litigation with your payment provider, the funds will not be eligible for a refund because of our obligations towards the payment provider.
  3. If there is any problem related to the service provided in an order. We encourage you to use customer support to try to resolve the problem.
  4. UseFreelancer.com, through its Payment Service Provider, reserves the right to cancel orders or place funds on hold for any suspected fraudulent transactions made on the Site.
  5. All transfers and assignments of intellectual property to the Buyer are subject to full payment and delivery cannot be used if payment is canceled for any reason whatsoever.
  6. If an order is canceled (regardless of the reason), the funds paid will be returned to the buyer's balance.
  7. Revisions to deliveries can be made by sellers based on the seller's work and customer service. Sellers can determine how many revisions they wish to offer, including no revisions.
  8. Review requests may be made through the Order page while the order is marked as Delivered.
  9. It is not permitted to ask sellers to obtain additional services beyond the agreed requirements by using the Request Revisions button.

Order Cancellations

  1. UseFreelancer.com encourages purchasers and sellers to resolve service disputes with each other using the Resolution Centre.
  2. Eligibility for UseFreelancer.com order cancellation requests will be evaluated by our customer support team based on several factors. Including violations of our terms of service and/or our standards, general misconduct, and improper use of the UseFreelancer.com delivery system.
  3. Completed orders (or, where applicable, completed steps) may be canceled, after review by our customer support team, up to 14 days after the order (or step) has been marked as complete. Please note that orders cannot be partially canceled (ie. we can only cancel the whole order if warranted).
  4. In rare circumstances where we find it appropriate, our Customer Support team may cancel a completed order even after 14 days have passed from its completion. If this happens, the amounts paid for the canceled order will be returned to the buyer's balance. and shall be deducted from the seller's balance or, if there are insufficient sums in the seller's balance, from the seller's future income.
  5. Orders may not be canceled based on the quality of service/materials provided by the seller if the service was rendered as described on the Gig page. You may rate your experience with the Seller on the Order Page, including the level of service quality, received.
  6. You must use UseFreelancer.com Resolution Center to respond to your concerns and desired resolution related to the service provided by their vendor before contacting customer support. Customer Support will not take any action against the Orders when the requestor has not informed his Seller of the problems related to the Seller's service. And let the salesmen provide a resolution first. It does not include unauthorized use of UseFreelancer.com.
  7. Any unauthorized use of UseFreelancer.com during an order, after review by our customer the support team may cause the order to be canceled. This includes, but is not limited to, harassment, unlawful conduct, or other violations of the UseFreelancer.com Terms of Use.
  8. UseFreelancer.com Customer Support will cancel orders for the following reasons, without limitation:

Active orders(After the requirements have been submitted to the Seller and before the Seller delivers on UseFreelancer.com):

  1. The seller is late and does not reply for more than 24 hours while the order is flagged as Late.
  2. Users abuse the other party by threatening low ratings or leveraging order documents (like identifiers, personal information) against each other.
  3. Users have provided or included infringing materials or a trademark as part of their requirements or the vendor's delivery.
  4. The user is no longer an active UseFreelancer.com user because of breaches of the Terms of Service or account closure.

Delivered Orders (after the seller clicked on Deliver Now and before the order is marked complete)

  1. The seller uses the delivery system to extend the delivery deadline to supplement the requested service without providing the final service delivered. Note: Multiple reported breaches will result in permanent suspension of your account.
  2. The seller does not deliver any files and/or proof of work related to the agreed order requirements. Note: Our client support team will examine the subjectivity of the documents in question.
  3. The seller requests additional payments, on or outside the UseFreelancer.com platform, with the final delivery of services directly related to the agreed requirements.
  4. The Seller is withholding the final delivery of services to get improved ratings.
  5. Users who abuse the Request Revisions button to get more services from sellers beyond the agreed requirements.
  6. Users who threaten to leave a negative opinion to obtain more services from the seller not related to the agreed requirements.

Completed Orders (after the order is complete and within the 14-day time limit)

  1. Users who allegedly used infringes documents or trademarks after verification and proof.
  2. UseFreelancer.com Customer Support will look at cases of Order delivery manipulation that prevents users from fully using our resolution center that allows the order to be marked as complete..

Chargebacks

UseFreelancer.com examines debits charged by the payment provider and disputes on behalf of sellers. Although the results vary from case to case due to each reason for back billing, we work hard to resolve disputes in the seller's favor. If the chargeback case allows. UseFreelancer.com (or one of the payment service providers of UseFreelancer.com) will return the parts or the total income to the Seller, otherwise the fee amount will be borne by the Seller.


Refunds

  1. UseFreelancer.com does not automatically refund payments made for canceled orders back to your payment provider. Funds from order cancellations are returned to the Buyer's UseFreelancer.com account and are available for future purchases on UseFreelancer.com. UseFreelancer.com will return the service charge to your UseFreelancer.com account when the order is canceled. Anyway. If the service fee has not been returned to your UseFreelancer.com Balance following an order cancellation, the amount of this service fee will be waived from your next purchase on UseFreelancer.com.
  2. Refunds of deposits (ie. refunds directly to your payment provider) can be made by our customer support team, according to the amount and currency of the initial payment of the order. To prevent fraud and abuse, we limit the total number of times users can request a refund from the payment provider, which is subject to review by our customer service team. These refunds can be subject to additional costs.

General Terms


Modifications

  1. UseFreelancer.com may make changes to this Payment Arrangement from time to time. When these changes are made, UseFreelancer.com will re-create a copy of the conditions available on this page.
  2. You understand and agree that if you are using UseFreelancer.com after the date the payment terms changed. UseFreelancer.com will regard your use as an acceptance of the updated payment conditions.

Disclaimer of Warranties

YOUR USE OF THIS SITE, ITS CONTENT, AND ANY SERVICE OR ELEMENT OBTAINED THROUGH THIS WEBSITE IS AT YOUR OWN RISK. THE SITE, ITS CONTENT AND ANY SERVICES OR MATERIALS OBTAINED FROM THE WEBSITE.
